DRAFT — NOT FINAL. Placeholder language for legal review (Katie). Do not publish.

Official Rules

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. This is a draft for legal review and is not the final, governing version. [TODO: legal to confirm all bracketed items and final language.]

1. No purchase necessary

No purchase, payment, deposit, or card linking is required to enter or to win. Linking a card is one method of entry; a free mail-in method with equal odds is available to everyone (see Section 5). Purchasing anything, or spending more on a linked card, does not increase your chances of winning.

2. Sponsor

The Sponsor of this sweepstakes is Winsome [TODO: legal to confirm full legal entity name and address — e.g., Winsome, Inc.], located at [Mailing address — TODO confirm before launch] (the "Sponsor"). The sweepstakes is administered by the Sponsor and is in no way sponsored, endorsed, administered by, or associated with Plaid, Visa, Tremendous, or any card issuer.

3. Eligibility

The sweepstakes is open only to legal residents of the United States who are at least 21 years of age at the time of entry, excluding residents of Florida and New York. [TODO: legal to confirm age threshold and excluded states.] Void in Florida, New York, and wherever else prohibited or restricted by law. Employees, officers, and directors of the Sponsor and its affiliates, and their immediate family and household members, are not eligible. By entering, each entrant represents that they meet these requirements.

4. Promotion Period

The sweepstakes runs as a series of weekly drawings. Each weekly entry period closes at the cutoff time on Thursday, and that week's drawing is conducted shortly after. [TODO: legal to confirm exact cutoff and drawing times, time zone, and overall start/end dates of the promotion.] The Sponsor's clock is the official timekeeper.

5. How to enter

There are two ways to enter each weekly drawing, both free:

(a) Standard method (card linked). Create a Winsome account and link an eligible debit or credit card through Plaid (read-only). Maintaining an "active account" during the entry period earns entries automatically. An active account is defined as [TODO: legal to confirm — e.g., at least 5 purchases at 5 or more different merchants in the trailing 30 days]. No purchase beyond your normal spending is required, and no spending threshold improves your odds.

(b) Free mail-in method (AMOE). To enter without linking a card, hand-print your full name, complete mailing address, date of birth, and email address (if you have a Winsome account) on a 3"×5" card and mail it in a stamped envelope to: Winsome — Free Entry, [Mailing address — TODO confirm before launch]. Each mailed card receives one (1) entry into the next eligible weekly drawing and has the same odds as any standard entry. To be entered into a given week's drawing, a card must be postmarked by and physically received before that week's Thursday cutoff; otherwise it is entered into the next eligible drawing. [TODO: legal to confirm per-period entry limits, mechanical-reproduction prohibition, and duplicate-detection handling.]

6. Drawing & odds

For each weekly drawing, one or more potential winners are selected at random from all eligible entries received during the entry period using an auditable random-selection process that is sealed before results are announced. [TODO: legal to confirm selection mechanism and any audit/escrow details.] The odds of winning depend on the total number of eligible entries received for that drawing.

7. Prizes

Each weekly drawing awards cash prizes. [TODO: legal to confirm prize amounts, number of winners per drawing, and total weekly prize value — figures shown elsewhere on the site (e.g., "$10,000") are representative placeholders.] Prizes are paid electronically via Visa through Tremendous [TODO: legal to confirm payout provider and method]. No transfer, assignment, or substitution of a prize is permitted, except that the Sponsor reserves the right to substitute a prize of equal or greater value if the advertised prize becomes unavailable.

8. Winner notification & verification

Potential winners will be notified using the contact information associated with their entry. A potential winner may be required to verify identity and eligibility before a prize is awarded; the level of verification may scale with the value of the prize. [TODO: legal to confirm notification window, required documentation, and response deadline.] Failure to respond, to meet eligibility requirements, or to complete verification within the stated period may result in disqualification and selection of an alternate winner.

9. Taxes

Winners are solely responsible for all federal, state, and local taxes on prizes. Where required by law, the Sponsor will request a completed IRS Form W-9 and will issue an IRS Form 1099 once a winner's cumulative winnings reach the applicable reporting threshold. [TODO: legal to confirm tax handling, reporting threshold, and withholding for non-compliant winners.]

10. Publicity

Winners are identified publicly by username only; the Sponsor does not publish winners' real names or likenesses. [TODO: legal to confirm publicity-consent language and any state-specific exceptions.] A list of winners is available on written request to the Sponsor's address above for a limited period after each drawing.

11. General conditions, disqualification & fraud

The Sponsor may disqualify any entrant who tampers with the entry process, operates multiple or fraudulent accounts, uses bots or automation, or otherwise violates these rules. The Sponsor reserves the right to suspend, modify, or terminate the sweepstakes if fraud, technical failure, or any factor beyond its reasonable control compromises the integrity of the promotion. [TODO: legal to confirm.]

12. Limitation of liability

By entering, entrants agree to release and hold harmless the Sponsor and its affiliates, and their respective officers, directors, employees, and agents, from any claim or liability arising from participation in the sweepstakes or acceptance or use of any prize, to the fullest extent permitted by law. [TODO: legal to confirm full limitation-of-liability and release language.]

13. Disputes & governing law

These rules are governed by the laws of [TODO: legal to confirm governing state], without regard to conflict-of-law principles. [TODO: legal to confirm dispute-resolution terms, including any arbitration and class-action-waiver provisions, and venue.]

14. Privacy

Information collected from entrants is used in accordance with the Winsome Privacy Policy. Read-only financial data accessed via Plaid is used to confirm active accounts and for the Sponsor's anonymized data-panel insights, as described in the Privacy Policy.
